Terms of service

1. Who you are contracting with
The Magic is published by THE MAGIC SpA, a Chilean Sociedad por Acciones (SpA) with tax ID 78.052.234-8, registered at Nueva Andrés Bello 1860, Independencia, Región Metropolitana de Santiago, Chile. Contact: contacto@themagicclspa.com.
2. What is being sold
A licence to use the The Magic source code: a Node.js application starter containing user accounts, subscription billing, transactional email and the supporting scripts and documentation. It is source code for developers, not a hosted service and not a finished application for end users.
You are buying a licence, not ownership of the code. What the licence permits is set out in full on the licence page, which forms part of these terms.
3. Who sells it to you
Orders are processed by our payment provider, who acts as merchant of record. Legally, they are the seller in the transaction: they charge your card, apply and remit any VAT or sales tax due in your country, and issue your invoice. Your card statement may show their name rather than The Magic; the exact descriptor appears at checkout and on your receipt.
Their buyer terms govern the payment itself. These terms and the licence govern your use of the code.
4. Delivery
A private Git repository invite, plus a downloadable zip of the same code. Immediately after payment, automatically, to the email used at checkout. The full terms are on the delivery page.
5. Requirements
Node.js 20 or newer and any PostgreSQL database. You are responsible for your own hosting, your own database and your own payment provider account. We do not host anything on your behalf.
6. Support
Email support at contacto@themagicclspa.com, answered within two business days. Support covers the code as delivered: installation, defects, and questions about how a shipped feature works. It does not cover writing your product for you, debugging changes you made, or your hosting provider.
7. Refunds
14 days from purchase, for any reason, without having to explain yourself. See the refund policy.
8. Updates
Updates published for the version line you bought are included and available at no extra cost. We do not promise a release schedule, and a future major version may be a separate paid product.
9. Acceptable use
You may not use The Magic to build anything unlawful, nor redistribute the kit itself. Breaching the licence terminates it; breaching it does not entitle you to a refund of a licence already used.
10. Warranty and liability
The code is provided "as is", without warranty of any kind. We do not warrant that it is free of defects or fit for a particular purpose. To the extent permitted by law, our total liability arising out of your use of it is limited to the amount you paid.
You are responsible for what you deploy: your own security review, your own data protection obligations, your own compliance with the law where you operate.
11. Changes
We may update these terms for future purchases. The version in force when you bought is the one that applies to your purchase, and it is the one shown on your receipt date.
12. Governing law
The laws of the Republic of Chile, with the ordinary courts of Santiago competent, without prejudice to any mandatory consumer rights you have where you live.
